The deal, in plain words.
You keep everything you make. We keep it online and reachable at one link. Neither of us gets to be unreasonable about it.

These terms govern your use of ApnaSurprise, operated by Pawan Kushwah (“we”, “us”). By building or buying a gift you agree to them. If you do not, don't use the service.
What the service is
You assemble a personal gift page — photos, a written message, a soundtrack — and we host it at a private link you can send to someone. Building is free. You pay once, at the end, and only then does the link get minted.
Accounts
You can use the whole product without an account; a gift is tied to a signed cookie in your browser instead. That cookie is the only thing connecting you to an unclaimed gift, so clearing your browser data without having made an account can lose your access to a gift you paid for. Making an account is the fix, and we say so on the screen where it matters.
If you do make one, keep the password to yourself and tell us if you think somebody else has it. You are responsible for what happens under your account.
What you pay for
Prices are shown in Indian Rupees on the checkout screen, inclusive of any taxes stated there, and are the prices we charge — the page reads them from the same catalogue the payment does, so what you see is what is billed. Payment is handled by Razorpay; we never receive your card details.
Your plan and any add-ons determine what the gift can do — a custom link, a scheduled unlock time, how long it stays up. Some plans host the gift indefinitely; time-limited plans state their term at checkout. Add-ons and entitlements are written only by the payment path, so an edit made later cannot grant a paid feature you did not buy.

Your content stays yours
The photos and words you upload remain entirely yours. You grant us only the narrow licence we need to run the service: to store your content, and to display it to whoever opens your gift link, for as long as the gift is live. That licence ends when the gift is deleted. We do not use your gift in marketing, we do not show it to anyone else, and we do not train anything on it.
You confirm that you have the right to upload what you upload — that the photos are yours to share, and that the people in them would not object.
What you can't use it for
- Anything unlawful, or content that harasses, threatens, defames or sexualises anybody.
- Content involving a minor in any sexual or exploitative way. This is the one thing we report rather than merely remove.
- Impersonating someone else, or sending a gift designed to deceive its recipient about who it is from.
- Uploading material you do not hold the rights to, including copyrighted photographs and music.
- Attacking the service: scraping it, brute-forcing gift PINs, probing for vulnerabilities, or working around rate limits.
We can take down a gift that breaks these rules, and close the account behind it, without a refund. We would rather write to you first, and usually will.
Gift links and PINs
A gift link is private but not secret: anyone holding it can open the gift, so treat it the way you would treat the gift itself. If you set a PIN, we cannot recover it — it is stored as a hash and the plaintext never leaves the browser that set it. Losing the PIN means rebuilding the gift.
Scheduled gifts stay sealed until the moment you chose. The link works before then; it simply will not open the contents.
Availability
We work to keep gifts reachable and we do not promise perfection. There will be maintenance, and there will be occasional failures at our hosting, storage or payment providers. If a gift of yours is unreachable for long enough to matter, write to us — see Refunds & cancellations for what happens then.
Where we stand on liability
The service is provided as it is. To the extent the law allows, we are not liable for indirect or consequential loss — a missed occasion, a disappointed recipient, lost profit — and our total liability for any claim is limited to what you actually paid us for the gift in question.
Nothing here limits liability that cannot be limited by law, including for fraud, or your rights under the Consumer Protection Act 2019.
Changes to these terms
We may update these terms; the date at the top says when we last did. A change never applies retroactively to a gift you have already bought. If a change is significant and you have an account, we will tell you.
Law and jurisdiction
These terms are governed by the laws of India, and the courts at Tiwariganj, Lucknow, Uttar Pradesh, 226028, India have exclusive jurisdiction over any dispute.
